General business terms & conditions online-shop myhotscarf.com (a webshop from Luzproducts, owner Lucia van der Meer Enthoven)

Introduction

These General Business Terms (abbreviation in German: “AGB”) of myhotscarf.com (a webshop from Luzproducts, owner Lucia van der Meer Enthoven, hereinafter myhotscarf.com) shall apply to all services and products of Myhotscarf.com. Described as customer is each natural person or legal entity as well as a partnership with legal capacity which maintains business relationships with Myhotscarf.com

1. Scope

1.1 All contracts with my myhotscarf.com are exclusively subject to these General Business Terms. General Business Terms, which contradict or deviate from the following provisions, shall not apply. This shall also apply if in the knowledge of contradictory or deviating terms and conditions we carry out the delivery and service without reservation.

1.2 Contradictory or deviating General Business Terms of customers shall not be recognised unless Myhotscarf.com had explicitly approved such in writing.

1.3 The General Business Terms of Myhotscarf.com can be changed at all times. The respective actual and binding version of the General Business Terms is published under www.myhotscarf.com

2. Prices

The prices listed in the offer at the time of the order shall apply to orders in our online shop whereby the right is reserved to an error in the declaration. The stated prices are final prices; this means they include the Swiss value added tax.

3. Contract

The products, services and prices, which are published under www.myhotscarf.com, shall be deemed as an offer. This offer is subject to the condition subsequent of impossibility for delivery or false price details (on the part of myhotscarf.com).

The contract shall be concluded as soon as the customer places his order via the online shop. The receipt of the order shall be reported to the customer by means of an automatically generated order confirmation by e-mail. This confirmation does not contain any assurance that the product is also actually available or can be delivered.

If one of the afore-mentioned conditions (subsequent) occurs the contract will be dissolved immediately and without the assistance of the parties. The customer shall be informed hereof immediately. As a result of such dissolution of the contract myhotscarf.com is not obliged to a substitute delivery.

4. Terms of payment

4.1 Myhotscarf.com principally offers the payment forms, advance payment, credit card or paypal and in no case takes over the costs for the monetary transaction.

4.2 In case of advance payment, the payment has to be received by no later than five days after the order at Myhotscarf.com. If the customer is in default with the payment Myhotscarf.com can charge a dunning fee in the amount of Fr. 20.-.

5.  Terms of delivery

5.1 As a rule shipping shall be carried out 1-3 workdays after receipt of the payment at the address stated by the customer. If the ordered product or a part of an order is not available ex warehouse then the customer shall be contacted by myhotscarf.com. Myhotscarf.com uses Swiss post or DHL for delivery.

5.2 Delivery costs are as follows:

Switzerland

  • Swisspost Postpac priority (1-2 days)
  • CHF 7.90 CHF for orders below 150 CHF

Free shipping for orders above 150 CHF

Europe

Swisspost International Economy or DHL (up to 2 weeks)

  • 19.90 CHF for 1 Hotscarf
  • 29.90 CHF for 2 Hotscarfs or more

Swisspost International Priority or DHL (up to 1 weeks)

  • 24.90 CHF for 1 Hotscarf
  • 34.90 CHF for 2 Hotscarfs or more

Free shipping for orders above 240 CHF.

5.3 All Products are sold on Delivery Duty unpaid basis. Recipients outside Switzerland may have to pay import duty or a formal customs entry fee prior to or on delivery and additional taxes, fees or levies may apply according to local legislation. These costs are for the customer’s account.

5.4 In order to guarantee the smooth service of parcels and written correspondence the customer undertakes to notify any changes to address or name immediately by citing the order number.

6. Warranty

The customer has to inspect the delivered goods directly and must report possible defects to myhotscarf.com immediately. After coordination with myhotscarf.com the defective goods are to be sent to the registered seat of myhotscarf.com by stating the account details for the repayment of that which was already paid. Costs and risk of the return shipment shall be borne by the customer. If the complaint proves to the substantiated the return payment shall be redeemed within five days after receipt.

7. Cooling-off period

The customer can, for any reason, return their order to Myhotscarf.com within 14 working days after delivery. The product has to be undamaged, unused and packed in the original packaging. Myhotscarf.com will refund the costs of the product. The shipping costs for sending and returning the product are for the customer’s account.

8 Exclusion of liability

8.1 Myhotscarf.com guarantees that the ordered product is sent out undamaged and in good condition. The goods are sold “as is”. No warranty applies. Myhotscarf.com is not responsible for any damage caused by delivery or by using the product. Myhotscarf.com does not guarantee if the product is suitable for the customer’s intended application or has a particular desired effect.

8.2 Myhotscarf.com is only liable for direct damageif the damage has been caused by the willful or grossly negligent act and is limited to the selling price of the product. Liability for direct damages in cases of slight negligence-regardless of legal grounds- is expressly excluded.

8.3 Myhotscarf.com does not accept any liability for indirect damage or consequential damage of any kind, regardless of the legal ground. Shipping and using the product shall be at the buyer’s risk.

Damages attributable tonatural wear and tear,damage caused by incorrect use, improper use, not complying with security instructions, external influences or product specific wear and tear and damage that did not result on the object of the delivery itself, are excluded.

9. Data protection

Myhotscarf.com shall only store the data, which are necessary for the customer service, notably the customer’s order and address data for use within the framework of the processing of the order. Myhotscarf.com values the protection of their customers and attaches great importance to the sensitive handling of customer’s data.

10. Place of jurisdiction

The place of jurisdiction is subject to the mandatory places of jurisdiction according to the Swiss Code of Civil Procedure of the registered seat of myhotscarf.com.
